And any individual or legal entity wishing to make a purchase via the website
myhadaya.co, hereinafter referred to as "the Customer".
The acquisition of a product via this site implies unreserved acceptance of
these GTC.

These GTC define the rights and obligations of the parties in connection with
the online sale of products offered by MY HADAYA, a modest fashion ready-to-wear
brand.
2. GENERAL PROVISIONS
These GTC are accessible at any time on the site and prevail over any other
document.
The Seller reserves the right to modify the GTC at any time. The applicable
conditions are those in force on the date of order validation.
3. PRODUCTS
The products offered are those listed on the myhadaya.co site at the time of
consultation.
Each item is accompanied by a precise description. Despite the care taken, a
slight variation in color or cut may occur depending on screens or
manufacturers.
Products are offered in limited quantities, available only during 3 to 5-day
sale periods, several times a month.
4. PRICE
Prices are indicated in euros (€), all taxes included (TTC) if applicable.
Shipping costs are calculated at the time of order validation.
Customs duties or local taxes may apply in certain countries (especially for
deliveries to Europe). These costs are the sole responsibility of the Customer.
5. ORDER AND ONLINE CONTRACT
Any order implies acceptance of the prices and description of the products.
The ordering process includes several steps (selection, cart, identification,
address, delivery method, payment).
Once payment is validated, the order is considered firm and a confirmation
email is sent.
The Seller reserves the right to refuse an order in case of a previous dispute
or suspicion of fraud.
6. PAYMENT TERMS
Payment is due immediately upon order.
It is made online via a secure solution (credit card, PayPal, or any other
indicated provider).
Bank details are not stored by MY HADAYA at any time.
7. PREPARATION & DELIVERY
Orders are prepared within 7 to 10 business days, due to import from the
United Arab Emirates or Turkey.
Deliveries are ensured:
- In France
- Throughout Europe
- In the United Arab Emirates
Delivery times vary according to the destination country and are provided as
an indication (between 5 and 10 business days on average).
Shipping costs are calculated according to the destination and the weight of
the package.
The Seller cannot be held responsible for delays attributable to the carrier
or customs services.
8. RIGHT OF WITHDRAWAL
Due to the ephemeral nature of sales and limited quantities, no right of
withdrawal applies once the order is validated.
No refund is offered, except in exceptional cases (proven order error or
product defect). The Customer is invited to carefully read the product sheets
before ordering.
9. RETURNS & CREDIT NOTES
In case of exceptional return agreement, a credit note valid for 30 days will
be issued after receipt of the returned item.
The item must be:
- New, unworn, unwashed,
- With its original tags.
Return shipping costs are the responsibility of the Customer.
10. LEGAL GUARANTEES
In accordance with applicable regulations, the Seller is responsible for the
conformity of the delivered products and any defects.
Any claim related to a manufacturing defect must be made in writing within
48 hours of receipt.
11. COMPLAINTS
For any questions or complaints, the Customer can contact customer service

Response guaranteed within 48 to 72 business hours.
12. RETENTION OF TITLE CLAUSE
Products remain the property of MY HADAYA until full payment of the price.
13. INTELLECTUAL PROPERTY
All elements of the myhadaya.co site (texts, photos, design, logo, etc.) are
the exclusive property of MY HADAYA.
Any reproduction, even partial, is prohibited without prior authorization.
14. FORCE MAJEURE
The Seller cannot be held responsible for the non-performance of the contract
in case of force majeure (strike, natural disaster, pandemic, customs
blockage, etc.).
15. APPLICABLE LAW – JURISDICTION
These GTC are governed by the law in force in the United Arab Emirates.
In case of dispute, an amicable solution will be sought. Failing that, the courts
of the United Arab Emirates shall have sole jurisdiction.
